Astrid Wagner is an artist based in Vienna. Her work engages with the relationships between art, gender, class, and origin.
She examines the thresholds of art and mainstream culture, with a particular interest in the performative aspects of built and social space — including the stage. Her practice is media- and material-open, developed both in site-specific exhibition contexts and in ongoing series. Text works form an independent part of her practice. She has taught as senior lecturer and lecturer at art universities.

§1 Scope and Application
These General Terms and Conditions (“Terms”) govern all purchases made through this online shop by consumers and business buyers. A consumer is any natural person who concludes a legal transaction for purposes outside their professional or commercial activity.These Terms apply to all orders placed within the European Union. Buyers are responsible for any applicable import duties or local regulations in their country of residence.
§2 Conclusion of Contract
The presentation of artworks in our online shop does not constitute a legally binding offer but an invitation to place an order (invitatio ad offerendum).
By submitting your order, you make a binding offer to purchase the selected work. You will immediately receive an automated confirmation of receipt by email. This confirmation does not yet constitute acceptance. A binding contract is formed only when we send a separate order confirmation email, or when we dispatch the goods. We reserve the right to decline an order, for example in the event of payment failure or unavailability.
§3 Prices and Payment
All prices shown are final prices. No VAT is charged pursuant to § 6(1)(27) UStG (Kleinunternehmerregelung — small business exemption). Shipping costs are calculated separately and displayed at checkout before order confirmation.
IMPORTANT — displayed clearly before checkout: Payment method: Advance payment (Vorkasse) only. After placing your order, you will receive our bank account details by email. Payment must be received in full within 7 calendar days of the order confirmation. Your order will be processed and dispatched only after full receipt of payment. If payment is not received within this period, the order will be automatically cancelled. Ownership of the work passes to the buyer only upon receipt of full payment (retention of title / Eigentumsvorbehalt).
§4 Availability and Product Descriptions
All works are offered subject to availability. As artworks may be unique or exist in very limited quantities, availability cannot be guaranteed after the order is placed. In the event that a purchased work is no longer available, we will notify you immediately and refund any advance payment made in full.
Product images are reproduced as accurately as possible. However, slight variations in colour, surface texture, or finish may occur depending on your screen calibration and display settings, as photographic reproduction cannot fully capture the material qualities of an original work. Such variations do not constitute a defect. The artist’s description of each work (title, medium, dimensions, edition number) is provided to the best of our knowledge and is binding.
§5 Artwork Types — Unique Works and Limited Editions
This shop offers two categories of work:
(a) Limited Editions (Auflagen): Works produced in a defined, numbered series. Each edition is clearly marked with its edition number and total print run (e.g. “3/10”).
(b) Unique Works / Originals (Unikate): One-of-a-kind works that exist as a single object. These are clearly marked as “Unique” or “Original” in the product listing.
The applicable withdrawal rights for each category are set out in §6 below.
§6 Right of Withdrawal
(a) Limited Editions: As a consumer within the EU, you have the right to withdraw from your purchase of a limited edition work within 14 days of receiving the work, without giving any reason. To exercise this right, you must notify us in writing (email is sufficient) within the 14-day period, using the model withdrawal form provided in the Appendix or any other clear statement.
Upon valid withdrawal, we will reimburse all payments received, including standard delivery costs, within 14 days of receiving your withdrawal notice — provided the returned work has been received by us or you have supplied proof of return. We will use the same payment method as used for the original transaction. We may withhold reimbursement until we have received the returned work.
The buyer bears the direct cost of returning the work. The work must be returned in its original condition, using the original or equivalent protective packaging, with no signs of damage, alteration, or use beyond what is necessary to inspect the piece. We reserve the right to deduct from the refund an amount reflecting any diminished value caused by handling beyond what was necessary to assess the work.
(b) Unique Works / Originals: The right of withdrawal does not apply to the purchase of unique, one-of-a-kind original works, pursuant to Art. 16(c) of EU Directive 2011/83/EU, as these works are by their nature non-resaleable in their original condition once delivered. The applicable category (unique or edition) is clearly stated in each product listing and confirmed at checkout.
The model withdrawal form is provided in the Appendix to these Terms.
§7 Shipping and Transfer of Risk
We ship within the European Union. Shipments to Switzerland and Norway are available upon request; additional duties, taxes, or customs clearance costs applicable in those countries are the sole responsibility of the buyer.
All works are carefully packaged to ensure safe transit. Once the work has been handed over to the shipping carrier, the risk of loss or damage transfers to the buyer (for consumer purchases, the risk transfers upon physical delivery to the buyer or a designated third party). In the event of transport damage, please document the damage immediately upon delivery and contact us within 48 hours.
If a buyer provides an incorrect or incomplete delivery address, any additional costs arising from re-delivery or address correction are borne by the buyer.
Estimated delivery times are provided in good faith but cannot be guaranteed. In the event of delays beyond our control (force majeure, carrier disruptions, customs), we will notify you promptly. Such delays do not entitle the buyer to cancel the order.
§8 Intellectual Property and Reproduction Rights
The purchase of a work transfers physical ownership of the artwork only.
All copyright, reproduction rights, and intellectual property rights remain exclusively with the artist. The buyer may not reproduce, photograph for commercial use, distribute, display publicly, or create derivative works from the purchased artwork without the prior written consent of the artist. This applies regardless of the format or medium of reproduction.
§9 Artist’s Resale Contribution
The artist is registered with Bildrecht GmbH, which administers the statutory Artist’s Resale Right (Folgerecht) under § 16b UrhG and EU Directive 2001/84/EC for qualifying commercial resales.
In addition to the statutory right, by purchasing a work from this shop, the buyer agrees that upon any future resale of the purchased work, a voluntary resale contribution of 20 % of the gross resale price (excluding shipping and transaction fees) shall be paid to the artist, Astrid Wagner, within 30 days of the completed resale transaction. This applies to any resale, whether private, through a gallery, auction house, online platform, or any other channel. The buyer undertakes to inform subsequent owners of this commitment. Payment details will be provided by the artist upon notification of resale.
§10 Liability for Defects
Statutory warranty rights apply pursuant to Austrian and EU law. If a work arrives damaged or with a defect not described in the product listing, please contact us within 14 days of receipt with photographs of the damage. We will arrange repair, replacement, or refund as appropriate. Claims for minor deviations in colour, surface texture, or finish from digital representations do not constitute a defect, as photographic reproduction cannot fully capture the material qualities of an original work (see §4).
§11 Limitation of Liability
We are fully liable for damages caused by intent or gross negligence. For minor negligence, liability is limited to foreseeable, contract-typical damage. Liability for indirect damages, loss of profit, or consequential damages is excluded to the extent permitted by Austrian law. Mandatory statutory liability (e.g. under the Austrian Product Liability Act / PHG) remains unaffected.
§12 Non-Payment
If the buyer fails to make advance payment within the specified period (§3), the order will be cancelled without further notice. If payment has been partially received, it will be refunded in full. We reserve the right to claim damages for costs incurred as a result of non-payment.
§13 Governing Law and Jurisdiction
These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. For consumers within the EU, mandatory consumer protection provisions of the consumer’s country of residence remain unaffected. The place of jurisdiction for disputes with commercial buyers is Vienna, Austria.
§14 Severability
Should any provision of these Terms be found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Shipping Policy

Shipping Region
We currently ship within the European Union. Deliveries to Switzerland and Norway are available upon request. Orders from outside these regions cannot be processed at this time. For Switzerland and Norway, buyers are solely responsible for any applicable import duties, VAT, or customs fees charged upon entry into those countries.
Payment Before Dispatch
All orders are dispatched only after receipt of full advance payment (Vorkasse). Please ensure your bank transfer is completed within 7 calendar days of your order confirmation. Orders for which payment is not received within this period will be cancelled automatically.
Processing Time
Orders are processed within 1–3 business days after full payment is received. For works requiring special packaging (e.g. oversized formats or fragile pieces), processing may take up to 7 business days. Any extended processing time will be noted on the individual product page.

These are estimates provided by our shipping partners and are not guaranteed. During peak periods (e.g. public holidays), delays may occur. We will notify you of any significant delay.
Shipping Costs
Shipping costs are calculated at checkout based on destination and package dimensions. The exact shipping cost will be clearly displayed before you confirm your order.
Packaging
All artworks are packaged with great care. Prints and works on paper are shipped flat (up to 30 cm) or rolled in reinforced protective tubes. Three-dimensional or fragile works are packed with additional cushioning materials. We are registered with an authorised packaging recovery system in accordance with Austrian and EU packaging regulations (Verpackungsverordnung). Packaging materials used are selected with environmental impact in mind. We are committed to using recyclable and eco-friendly packaging materials wherever possible.
Tracking
Once your order has been dispatched, you will receive a shipping confirmation email with a tracking number (where available by the carrier). You can use this to monitor your shipment directly on the carrier’s website.
Transfer of Risk
Risk of loss or damage transfers to the buyer upon handover of the work to the shipping carrier. For consumer purchases, risk transfers upon physical delivery to you or a person designated by you. In the event of visible transport damage, please document it with photographs immediately upon receipt and notify us within 48 hours at [your email].
Incorrect Address
Please ensure your delivery address is complete and accurate at the time of ordering. We cannot be held responsible for delays or non-delivery caused by an incorrect or incomplete address. Any additional costs arising from address correction or re-delivery will be charged to the buyer.
Force Majeure
We cannot be held liable for delivery delays caused by circumstances beyond our control, including but not limited to carrier disruptions, natural events, strikes, or customs processing delays. In such cases, we will inform you promptly and work to find a satisfactory solution.

2. What Data We Collect and Why
We collect and process personal data only to the extent necessary to operate this shop and fulfil our legal obligations.
(a) Order processing: When you place an order, we collect your name, delivery address, billing address, email address, and bank transfer reference. Legal basis: Art. 6(1)(b) GDPR — processing is necessary for the performance of a contract.
(b) Communication: If you contact us by email or telephone, we store the content of your message and your contact details in order to respond. Legal basis: Art. 6(1)(b) and (f) GDPR — legitimate interest in responding to inquiries.
(c) Technical data: When you visit our website, our hosting provider may automatically collect technical log data (IP address, browser type, date and time of access). This is processed for security and system stability purposes. Legal basis: Art. 6(1)(f) GDPR.

3. Sharing of Data with Third Parties
We share personal data only where necessary:
Shipping carriers: Your name and delivery address are passed to the chosen shipping service provider to fulfil delivery. These providers act as data processors under a data processing agreement (Art. 28 GDPR).
Payment processing: We use bank transfer (advance payment / Vorkasse) only. No credit card data or third-party payment platform data is processed by us.
Legal obligations: We may disclose data to authorities where required by law.
We do not sell, rent, or otherwise share your personal data with third parties for marketing purposes.
4. Data Transfers Outside the EU/EEA
Your personal data is processed and stored within the European Union / European Economic Area. No transfer of data to third countries outside the EU/EEA takes place.
Note for buyers in Switzerland: Switzerland is recognised by the European Commission as providing an adequate level of data protection. Transfers to Switzerland are therefore permissible without additional safeguards.
Note for buyers in Norway: Norway is part of the EEA and the GDPR applies directly.
5. Retention Periods
We retain personal data only for as long as necessary for the purpose for which it was collected, or as required by law. Order-related data (invoices, delivery records) is retained for 7 years in accordance with Austrian tax and commercial law (§ 132 BAO, § 212 UGB). After this period, data is deleted or anonymised.

Under the GDPR, you have the following rights:
